1. Who we are
ʻOhana Getaways LLC (“ʻOhana Getaways,” “we,” “us”) is a travel advisory based in Olathe, Kansas. We are an independent travel advisor of Fora Travel.
These Terms govern your use of ohanagetaways.travel and any travel planning services we provide. By using this site or engaging our services, you agree to them.
2. What we do — and what we don’t
We provide travel planning, coordination and advisory services. We research options, design itineraries, arrange reservations, coordinate logistics across a group, and support travelers before and during a trip.
We are not the provider of the travel itself. Hotels, resorts, airlines, tour operators, transportation companies, restaurants and other suppliers are independent third parties. We act as an intermediary in arranging those services. We do not own, manage, control or operate any supplier.
3. Supplier terms govern
Every booking is subject to the terms, conditions, deposit schedules and cancellation policies of the supplier providing it. Those terms — not ours — determine what is refundable, when payment is due, and what happens if plans change.
We will surface the relevant terms to you in plain language before you commit. It remains your responsibility to read them.
4. Pricing and availability
Quoted rates, availability and amenities are not guaranteed until confirmed by the supplier. Prices can change without notice until a booking is confirmed and paid according to supplier terms. Supplier errors in pricing or availability do not obligate us or the supplier to honor an incorrect rate.
5. Our compensation
We do not charge planning fees. Our compensation comes from the suppliers we book through, paid to us after travel is completed. You pay the same rates you would pay booking directly, and in many cases receive additional amenities.
This means we are only compensated when a trip is booked and taken. It also means our recommendations are shaped by fit, not by fee.
6. Payment authorization
Where you provide a payment card for us to use, it is held in Fora Travel’s secure vault rather than by us. By providing it you authorize us to charge it for the specific bookings you approve. We will confirm what is being charged before we do.
We will never request card details by email or text message. Card information should only ever be provided through the secure link we send you.
7. Your responsibilities
You are responsible for:
- Providing accurate traveler names exactly as they appear on passports or government identification, and accurate contact details
- Valid passports, visas, entry permits and any required travel authorizations
- Meeting health, vaccination and entry requirements for your destinations
- Reviewing current U.S. State Department advisories (travel.state.gov) and CDC travel notices (wwwnc.cdc.gov/travel/notices) for your destinations
- Arriving on time for flights, transfers and reservations
- Reviewing all confirmations and documents we send and telling us promptly if anything is wrong
Errors caused by inaccurate information you provide — including name corrections on airline tickets — may carry supplier fees that are your responsibility.
8. Travel insurance
We strongly recommend travel protection for every traveler, and we will offer it. Group travel concentrates non-refundable costs, and a single cancellation can affect an entire booking. If you decline coverage, you accept the financial risk of cancellation, interruption, medical expense, and loss.
9. Limitation of liability
To the fullest extent permitted by law:
ʻOhana Getaways is not liable for any loss, injury, delay, damage, expense or inconvenience arising from the acts, omissions, negligence, default, failure or insolvency of any supplier or third party.
We are not liable for events beyond our reasonable control, including weather, natural disaster, strike, labor dispute, mechanical failure, government action, civil unrest, epidemic or pandemic, border closure, or acts of terrorism.
Where we are found liable for any claim arising from our own services, our total aggregate liability is limited to the total commission we received in connection with the trip in question.
We are not liable for indirect, incidental, consequential, special or punitive damages, including lost enjoyment, lost profits, or lost opportunity.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Group bookings
Where one person acts as organizer or point of contact for a group, that person represents that they are authorized to act on behalf of the travelers in the group for the purpose of arranging travel. Each traveler remains individually responsible for their own bookings, payments and supplier terms.
11. Assumption of travel risk
Travel carries inherent risks that no advisor can eliminate. These include, but are not limited to, injury or illness, transportation accidents, weather and exposure, food and water conditions, activity-related injury, encounters with wildlife, and limited access to medical care in remote destinations. This list is not exhaustive, and unknown risks may arise.
By booking travel arranged by us, you accept responsibility for these risks on behalf of yourself and any travelers for whom you are booking, and you release ʻOhana Getaways from claims arising from them, including claims based on the negligence of third parties.
12. Indemnification
You agree to indemnify and hold harmless ʻOhana Getaways LLC, its members and representatives from claims, damages, losses, costs and reasonable attorneys’ fees arising from your breach of these Terms, from inaccurate information you provide, or from your use of this website other than as permitted here.
13. Time limit on claims
To the fullest extent permitted by law, any claim arising out of these Terms or our services must be brought within one (1) year after it arises, or it is permanently barred.
14. Dispute resolution
We would rather resolve any problem directly. Please contact us first and give us a fair opportunity to put it right. Any dispute not resolved that way is subject to the Governing Law section below.
15. Website content
Content on this site is provided for general information. We make no warranty that it is complete, current or accurate. Destination conditions, supplier offerings and pricing change frequently.
Links to third-party sites are provided for convenience. We do not control and are not responsible for their content or practices.
16. Relationship to Fora Travel
We are an independent travel advisor of Fora Travel. Fora Travel, Inc. is a separate company and is not the provider of the travel products it helps arrange. Fora’s own Terms of Use and Privacy Policy apply to its website, systems and booking tools, and to any booking made through them.
Seller-of-travel registrations held by Fora Travel, Inc. are Fora’s and are not held by ʻOhana Getaways LLC.
Where a booking is made through Fora’s systems, payment disputes, cancellations and service issues may be raised with us, with Fora, or with the supplier, as the circumstances require. We will assist in resolving them but do not control supplier decisions.
17. Intellectual property
All content on this site — text, photography, the ʻOhana Getaways name, logo and brand assets — is owned by ʻOhana Getaways LLC or used with permission. You may not reproduce, distribute or create derivative works from it without written permission.
18. Changes to these Terms
We may update these Terms. The version in effect when you engage our services governs that engagement. Material changes will be reflected in the “Last updated” date above.
19. Governing law
These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Johnson County, Kansas.
